Ellie J Photography - Terms & Conditions

These Terms and Conditions apply to all photography bookings with Ellie J Photography.

By booking a session with Ellie J Photography, you agree to these Terms and Conditions.

On the day of your session, you will be asked to sign a consent form confirming that you have read, understood and agreed to these Terms and Conditions.

If anything is unclear, please don't hesitate to ask. Ellie J Photography will be happy to explain any part of these Terms and Conditions before your booking.

The Terms and Conditions in force at the time of booking will apply to your session. Ellie J Photography reserves the right to amend these Terms and Conditions for future bookings.

Booking

The session fee is payable in full at the time of booking to secure your appointment. Payment may be made by bank transfer or cash. Your booking is not confirmed until the session fee has been received. The session fee is non-refundable and secures the time reserved for your appointment. Any request to rearrange a session will be considered in accordance with the cancellation policy below.

Vouchers

Gift vouchers are available for portrait sessions and are supplied in digital format by email together with a personalised gift letter. Vouchers are non-refundable, non-transferable and cannot be exchanged for cash.

Vouchers are valid for twelve months from the date of purchase and cannot be extended. Advance booking is strongly recommended, particularly for weekend appointments. Vouchers cannot be used in conjunction with any other offer or discount and cannot be redeemed against photographs from a previous session.

Voucher values may be used towards session fees and products. Any remaining balance will be issued as a new voucher with the same expiry date as the original voucher.

Newborn Sessions

Newborn sessions should ideally be booked during pregnancy to allow a provisional session date to be reserved around your due date. As babies rarely arrive exactly on time, please contact Ellie J Photography as soon as possible after your baby is born so that your final session date can be confirmed.

Newborn or Child/Family Sessions Including Dogs

Ellie J Photography is pleased to welcome well-behaved family dogs to newborn and child/family photography sessions.

The safety of your baby, child, family and dog is always the highest priority. You must be confident that your dog is safe around babies, young children and adults before booking this type of session.

Dogs must be healthy, fully vaccinated, appropriately wormed and under your control at all times.

Ellie J Photography reserves the right to end or modify any session if, in the photographer's opinion, a dog presents a risk to the safety or wellbeing of any person or animal.

You remain fully responsible for your dog's behaviour throughout the session. Ellie J Photography accepts no liability for any injury, damage or loss caused by a client's dog. You will be asked to sign a separate safety disclaimer before your session.

Newborn Package Deals

The following package options are available:

• Maternity, Newborn and Older Baby

• Newborn, Older Baby and Cake Smash & Splash

Package offers operate on a "buy two session fees, receive the third session fee free" basis.

All sessions within a package must be booked and paid for at the same time. Each session remains an individual booking for ordering purposes. Digital image collections, prints, products and any minimum purchase requirements apply separately to each individual session and cannot be combined across multiple sessions.

Cancellations

If Ellie J Photography needs to cancel your session due to illness, family emergency, severe weather or circumstances beyond reasonable control, an alternative appointment will be offered wherever possible. If this is not possible, your session fee will be refunded in full.

Clients must provide at least five clear days' notice if they wish to cancel or rearrange a session.

Where illness affects a baby or child and less than five clear days' notice can be given, every effort will be made to offer an alternative appointment. A maximum of two last-minute cancellations or rearrangements will be accepted. Any subsequent last-minute cancellation or rearrangement will result in the session fee being retained and a new session fee becoming payable before another appointment can be booked.

Studio and Location Sessions

You are responsible for arranging your own transport to and from the studio or agreed location. Sessions may be postponed due to severe weather or any other circumstances where Ellie J Photography believes it would be unsafe or impractical to continue.

Sessions will conclude once Ellie J Photography is satisfied that sufficient high-quality images have been captured. No refund or reduction in fees will be given where the full allocated session time is not required.

Requests for particular poses, props or images are always welcome but cannot be guaranteed. Factors including weather conditions, lighting, the cooperation of children or pets, and the wellbeing of newborn babies may affect what can safely be achieved during the session. For safety reasons, Ellie J Photography reserves the right to refuse any pose, prop or image request that is considered unsafe or unsuitable.

Parents and owners remain responsible for supervising their children and pets throughout the session.

To avoid distractions and to protect copyright, photography and video recording by clients or guests during the session is not permitted unless agreed in advance by Ellie J Photography.

Proof Images & Ordering

With the client's consent, a complimentary low-resolution, watermarked preview image may be shared on the Ellie J Photography social media channels. Participation is entirely optional and choosing not to give consent will not affect the service provided.

A password-protected online gallery containing low-resolution, watermarked proof images (in both colour and black & white where applicable) will normally be available within one to three weeks of your session, depending on workload.

To enable proof galleries to be delivered more quickly, a representative selection of images will be fully edited. The remaining proof images will receive a light edit to allow you to view your gallery, choose your favourite images and appreciate the overall style of the finished photographs. Once your order has been placed, all purchased images will receive Ellie J Photography's full professional editing before delivery.

Prior to your session, you may be asked which collection you are most likely to purchase. A sufficient number of images will then be included within your proof gallery to fulfil that collection while still allowing you the opportunity to upgrade to a larger collection should you wish.

All proof images remain the copyright and property of Ellie J Photography. Proof images are supplied solely for the purpose of selecting your favourite photographs and must not be copied, downloaded, screenshotted, reproduced, shared, edited or have watermarks removed or obscured in any way.

Unauthorised copying or use of proof images constitutes copyright infringement. Ellie J Photography reserves the right to withdraw gallery access and pursue any legal remedies available where appropriate.

Online proof galleries remain available for two days from the date they are first viewed. A single extension of up to 24 hours may be granted at the discretion of Ellie J Photography. Additional extensions may incur an administration fee.

If no order is received within two weeks of your gallery becoming available, your proof images may be permanently deleted unless a written extension (up to a maximum of one month) has been agreed in advance.

By placing an order, you confirm that you have carefully checked your image selection. Payment in full is due at the time of ordering unless an agreed payment plan is in place. Once editing, printing or production has commenced, orders for personalised products cannot be cancelled. Estimated turnaround times for completed orders are typically between seven days and four weeks, depending upon workload, product availability and supplier lead times. These times are provided as a guide only. Delays caused by professional laboratories, manufacturers, delivery companies or circumstances beyond Ellie J Photography's reasonable control shall not constitute a breach of contract.

Digital Files, Online Services & Archiving

Due to their personalised nature, once purchased digital images have been supplied they cannot be refunded, exchanged or substituted for alternative images. Clients are therefore asked to check their order carefully before confirming their final image selection.

Purchased digital images will normally be available to download for two weeks following delivery. Clients are responsible for downloading and securely backing up their purchased images during this period. Once the download period has expired, access to the files via the website may no longer be available.

Ellie J Photography strongly recommends keeping at least two separate backup copies of all purchased digital images.

Password-protected galleries, digital downloads, mobile gallery apps, animated slideshows and any other online services provided after delivery of your images are complimentary services supplied for your convenience. These services are not intended to provide permanent storage of your photographs and may be withdrawn or become unavailable without notice, for example if the service provider changes, discontinues the service or Ellie J Photography ceases to subscribe to it.

Mobile gallery apps, animated slideshows and similar online services are provided for online viewing only and are not supplied as downloadable products unless expressly stated.

Ellie J Photography may, at its sole discretion, retain purchased digital images for archival purposes. However, archived images should not be regarded as a permanent backup service. Clients are solely responsible for maintaining their own backups of the purchased digital image files.

Ellie J Photography cannot guarantee the long-term availability of archived images or any online services and accepts no responsibility for loss of access to online galleries, mobile gallery apps, slideshows or other complimentary services after delivery.

Retouching

Fully edited and lightly edited proof images are provided to demonstrate the style and quality of the finished photographs. Additional retouching requested after purchase, including the removal of objects, extensive skin retouching, body reshaping or other alterations beyond Ellie J Photography's standard editing style, may incur an additional charge. Final artistic editing decisions remain entirely at the discretion of Ellie J Photography.

Postage & Delivery

Professional prints and products are produced by carefully selected professional photographic laboratories. Postage costs are included where stated within the chosen collection or product price. High-resolution digital images are supplied by secure download. Where included within the purchased collection, images will be supplied on USB. Clients purchasing collections that do not include a USB may purchase one separately at the current price.

Ownership of physical products passes to the client upon delivery. Whilst Ellie J Photography will always assist where possible, responsibility for delays, loss or damage caused by postal or courier services passes to the delivery provider once goods have been dispatched.

Force Majeure

If Ellie J Photography is unable to fulfil its obligations due to circumstances beyond reasonable control, including but not limited to serious illness, injury, family emergency, fire, flood, extreme weather, equipment failure, power failure or any other unforeseen event, liability shall be limited to the refund of any monies paid. Ellie J Photography will not be liable for any indirect or consequential loss arising from such circumstances.

Ellie J Photography holds full Public Liability and Professional Indemnity Insurance.

Copyright & Reproduction

All photographs remain the copyright of Ellie J Photography in accordance with the Copyright, Designs and Patents Act 1988.

Clients purchasing digital images are granted a licence to use those images for their own personal, non-commercial use. Images may be printed, displayed and shared with family and friends. Purchased images may not be sold, licensed to third parties, entered into commercial competitions, used for commercial purposes or altered in a manner that misrepresents the work of Ellie J Photography without prior written permission.

Proof images remain the property of Ellie J Photography and may not be copied, downloaded, screenshotted, reproduced, shared or otherwise used without written permission.

Ellie J Photography accepts no responsibility for the quality of prints or other products produced by third-party suppliers that have not been supplied by Ellie J Photography.

Model Release

Session images may be used anonymously by Ellie J Photography for portfolio, advertising, marketing, educational, editorial, competition and promotional purposes. This may include use on the Ellie J Photography website, blog, studio displays, printed literature, professional publications, competitions, training materials, website providers, suppliers, professional organisations and trusted business partners where required for the promotion of Ellie J Photography and its services. No personal information, including names, addresses or contact details, will be published alongside your images without your separate consent.

Permission for social media use is entirely optional. Clients will be given the opportunity to indicate whether or not they are happy for images from their session to be shared on social media. Choosing not to consent will not affect the service provided in any way.

Data Protection

Ellie J Photography collects, stores and processes personal information in accordance with applicable UK data protection legislation. Personal information is used solely for the purpose of:

• Providing photography services

• Processing payments

• Maintaining business records

• Contacting clients regarding their booking or completed order

• Occasionally informing clients about new products, services or special offers.

You may opt out of marketing communications at any time. Financial records will be retained for the period required by UK tax legislation. Personal information and signed consent forms will be retained only for as long as necessary to meet legal, regulatory and legitimate business requirements, after which they will be securely deleted or anonymised in accordance with the Ellie J Photography Privacy Policy.

Where retained, purchased photographs are archived solely at the discretion of Ellie J Photography and should not be regarded as a permanent backup service.

Clients remain responsible for downloading and securely backing up all purchased digital images.

Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.
