ELLIE J PHOTOGRAPHY
TERMS AND CONDITIONS
The Terms and Conditions listed below are applicable for all photography bookings. By booking a sitting with Ellie J Photography, it is assumed that you agree to these. You will be asked to sign a Terms and Conditions agreement form on the day of your sitting.
If you are not sure of anything, or would like some more information about these T&Cs, just ask as I am here to help.
We reserve the right to change these Terms and Conditions at any time.
Due to the current global outbreak of Covid-19 (also known as the Corona Virus, coronavirus, Novel Coronavirus, SARS-CoV-2), the Photographer holds the right to cancel or reschedule sessions without notice, limitation, or justification. This is in line with the current WHO and Government recommendations in handling and containing the virus. Should a session be unable to proceed due to Covid lockdown or tier restrictions, the client may request the refund of their session fee or reschedule their session.
The Client agrees to read and comply with the Studio's Covid-19 safety requirements, which will be sent to the Client via email prior to their photography session. Failure to comply with the requirements will result in the cancellation of the session.
The relevant session fee is payable by the Client in full at the time of booking to secure your appointment. Payments can be made by bank transfer, cash or cheque payable to Lorraine Jardim. Please note, if paying by cheque your appointment will not be secure until your cheque has cleared. The sitting fee is non-refundable.
Vouchers can be purchased as gifts for portrait sessions. These are sent in digital format, (i.e. emailed to the purchaser along with a supporting letter explaining what the voucher entails). As vouchers are valid for one year and cannot be extended beyond that year (see conditions below) advance booking for the portrait session by the voucher's recipient is essential, particularly if a weekend is required, to avoid disappointment.
The following conditions apply to the purchase of Ellie J Photography vouchers:
Newborn Session Bookings
The best time to book a newborn session is before the birth to enable time to be reserved around the due date. Babies rarely arrive on time, so it is important that Ellie J Photography be contacted immediately after the birth to confirm a booking.
Newborn/Child with Dog Photography
Ellie J Photography offers newborn/child with dog portraiture as part of her standard newborn or child portrait sessions and has only experienced exciting and enjoyable sessions with no issues of concern. To ensure this remains so, guidance on this subject is provided on the website here and must be read prior to booking. Ellie J Photography will take every reasonable step to ensure safety during the session however, it is the sole responsibility of the Client/owners to control their dog(s) during the photography session. Clients must be confident prior to booking that their dog(s) can be trusted around their baby/child and should not book a session if there are any doubts in this regard. The Client, not Ellie J Photography, will be responsible should an incident of any kind arise from the behaviour of the dog(s) brought to the studio. The Client must also ensure that their dog(s) are house trained, healthy, fully vaccinated and wormed before bringing them into the studio for health and safety reasons. The Client will be asked to sign a disclaimer agreeing to all the above before the shoot commences.
Newborn plus Older Baby Session
If an older baby "sitter" session is purchased as part of a newborn package, the second session must be booked to take place no later than baby's first birthday. This is a standard portrait session, not a Cake Smash and Splash Session.
If Ellie J Photography has to cancel the appointment, an alternative date will be offered where possible. Where not possible, Ellie J Photography's liability shall be limited to a full refund of the sitting fee.
At least 5 days' notice is required for Client cancellations. An alternative date will be offered where possible but cannot be guaranteed.
For photography sessions involving babies and children, Ellie J Photography completely understands that illnesses can develop suddenly. For this reason, should a session be cancelled with less than 5 days' notice due to sickness, an alternative date will be offered where possible. Only two cancellations with less than 5 days' notice is allowed before the session fee is retained.
Studio and Location Portrait Session Details and Terms
Ellie J Photography will end the session at their discretion when it is determined that adequate images in terms of quality and quantity have been captured. There will be no refund or credit for unused time.
Ellie J Photography reserves the right to refuse a requested location for any reason.
Ellie J Photography will make every effort to comply with requests for specific photos. Please ensure these are notified in advance of the sitting. Due to factors such as weather or willingness/co-operation of subjects, it may not be possible for all of the images requested or expected to be captured. The Client is responsible for their children/pets at all sessions.
No cameras or cell phone cameras are allowed during a session.
Proof Images and Ordering
A low resolution, watermarked preview image will be available on my Facebook and Instagram business pages within 48 hours of the session. I will never identify clients on Social Media however, they are free to tag and share the image if wanted. This preview is not compulsory.
A password protected, on-line gallery of low-resolution watermarked proof images will be published up to 4 weeks (depending on workloads) after the appointment date. This will contain anywhere from 15 images upwards from an average baby/child/pet/cakesmash session. The number of images from a family group session will be dependent upon the number of group variations required and the average from a newborn session is 25 - 30, including family and individual parent images. In all instances, this number is dependent upon factors such as willingness/co-operation of subjects and the weather should the shoot be outside. If the total number of images is above or below the average amount, no credit will be given, or additional charges applied. All images are processed in both colour and black and white, although some images will not be suitable for black and white conversion and will be provided as colour only.
The gallery will remain live for a period of two days. After this time, it can be reinstated for a further 24 hours at a cost of £15.
Images not ordered within one-month of completion will be deleted, unless the Client requests an extension in writing (a one month limit applies to all extensions). The digital files of all purchased images will be archived.
Digital File packages start at £150. For print only purchases, there is a minimum spend of £150.
The proofs will have been professionally processed (i.e. correction of certain elements in an image such as minor physical flaws). More extensive re-touching may incur additional costs. Ellie J Photography is granted total artistic control over the final image.
Typically, an order is fulfilled between seven days and 4 weeks from receipt of payment for goods, depending on the products ordered and photographer's workloads/commitments. Ellie J Photography does not accept responsibility for any delays cause by supplier interruptions or the postal service.
Payment for items ordered must be made in full at the time of ordering. Print and product prices, which are subject to change at the discretion of Ellie J Photography, are available on the web site (prices valid at the time of placing an order will be honoured).
By placing an order with Ellie J Photography, the Client is committing to buy the ordered products.
Depending on print size requested, some cropping of an image may occur. Ellie J Photography will advise the Client if a particular print size ordered is unsuitable for the photograph in question.
Postage and Packing
Prints are posted out first class directly from our professional print lab and an additional fee to cover p&p is therefore applicable to each print order.
Digital file orders are sent via direct download to the Client's email address. A personalised CD of the images can be purchased and delivered to the Client's home address for an additional fee.
In the unlikely event of total photographic failure, injury or sickness beyond Ellie J Photography's control, their liability shall be a limited to a full refund of all monies paid. Your statutory rights are not affected. Ellie J Photography holds full Public Liability and Professional Indemnity Insurance.
Copyright and Reproduction
The copyright of all images remains with Ellie J Photography. The Client is permitted to reproduce their digitally purchased images for personal use only (i.e. not to alter or sell on in any way for profit, use for competition entry etc) This is a standard condition for Professional Photographers.
In the case of digital purchases, Ellie J Photography cannot be held responsible for the quality of print/products provided by a third party.
